1. Acceptance of Terms
By creating an account, downloading the Deskbook Windows application or Android APK, or accessing the Deskbook web application, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.
2. Software License and Cloud Access
Deskbook grants you a non-exclusive, non-transferable, revocable license to install and execute the Deskbook Windows Desktop application and Android application, and to access the Cloud Web service solely for your internal business operations in accordance with the user limits, branch limits, and document quotas of your subscribed plan tier (Silver, Gold, or Platinum).
3. User Accounts and Credentials
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify Deskbook immediately of any unauthorized use or security breach. Deskbook cannot and will not be liable for any loss arising from failure to secure passwords or screen lock codes.
4. Subscription Fees and Renewal
Subscription fees are billed on a monthly recurring basis as stated in your selected tier plus applicable Goods and Services Tax (GST). Services are billed in advance. Failure to pay recurring fees may result in suspension of cloud synchronization and web access, while your local desktop offline database remains intact.
5. Tax and Legal Compliance Disclaimer
Deskbook provides tools to calculate GST, generate HSN summaries, and produce tax invoices according to standard Indian GST rules. However, you acknowledge that you and your authorized tax professionals are ultimately responsible for verifying the accuracy of all tax classifications, rates, returns, and statutory filings.
6. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Deskbook and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business interruption, or procurement of substitute services.
7. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any legal disputes arising out of these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
